Duty-Free Car Import When Returning to Ukraine for Permanent Residence: Requirements and Pitfalls

Ukrainian law allows citizens to bring a car into Ukraine without paying import duty, excise tax or VAT when they move back for permanent residence (Article 374 of the Customs Code of Ukraine, Part 10, Clause 3). The conditions are strict: if even one is not met, customs will refuse the exemption and the car will be cleared on standard terms.

Who qualifies

The exemption is meant for citizens who lived abroad permanently and are returning to Ukraine to live permanently.

1. At least 3 years of residence abroad

You must document that you lived in the country you are leaving for at least three years before the day you receive the document confirming your right to permanent residence in Ukraine.

For Ukrainian citizens, customs clearance rules name a foreign passport with a "Permanent residence" stamp as this document. Consular registration is not listed in the law as a mandatory condition, but records of permanent consular registration and its removal help prove the length of residence. Check in advance which document you will receive, who issues it and on what date.

What does not qualify: refugee status and temporary protection, temporary consular registration (it only allows temporary import of a car for 60 days a year), a business trip, or simply having lived abroad for a long time, being married, or owning property in Ukraine without formal permanent-residence status.

2. At least 1 year of ownership

You must have owned the car, alone or jointly, for at least a year before the day you receive the permanent-residence document. If the car is subject to registration in the country you are leaving, it must have been registered there in your name on a permanent basis for at least a year. Buying a car just before departure and importing it duty-free will not work.

3. Import within 6 months

The car must enter Ukraine within six months of the day you receive the document confirming your right to permanent residence in Ukraine.

If you miss the deadline for a valid reason (an accident, force majeure or illness) and can document it, customs may extend it, but by no more than two years from the day the document was issued.

4. Quantity and vehicle categories

  • The exemption covers one unit per adult citizen from these categories: passenger cars (8703), vehicles for 10 or more people (8702), trucks up to 3.5 t (8704) and motorcycles (8711).
  • You may bring one trailer (heading 8716) together with the vehicle, if both are imported at the same time.
  • If spouses return together, each may import one vehicle, provided each meets all the personal conditions.

Restrictions after customs clearance

After clearance, the car is placed on temporary registration for up to 2 years.

  • For two years from the date of import you may not sell, give away or hand over ownership, use or disposal of the car to anyone other than family members.
  • You can sell or transfer it earlier, but only after paying all customs duties at the rates in force on the day the declaration is filed.
  • Documents for permanent use with the right to sell are issued after two years of permanent residence in Ukraine counted from the date of customs clearance.

Checklist before you leave

  1. Residence document and dates. Find out exactly which document confirming permanent residence in Ukraine you will receive (the "Permanent residence" stamp in a foreign passport), who issues it and from which date the deadlines run: 1 year of ownership and 6 months to import.
  2. Proof of 3 years abroad. Collect documents showing residence in the country you are leaving: permanent consular registration records, a residence permit, rental agreements, tax records.
  3. Vehicle documents. Check proof of ownership and how long the car has been registered in your name abroad (at least a year before the residence document is issued).
  4. Vehicle eligibility. Make sure the vehicle falls within the allowed categories (8702, 8703, 8704 up to 3.5 t, 8711).
  5. Current rules. Before importing, check the text of Article 374 and the customs clearance rules as they stand on the day you file the declaration.

Bottom line

The mechanism works, but it demands an exact paper trail. In the law, deadlines run from the date the permanent-residence document is issued in Ukraine, not from deregistering the car abroad and not from removal from consular registration. Before you start, consult a customs broker and get written confirmation of your document chain.
